Condominium Litigation

Overview

Allcock & Marcus has an experienced litigation team with an unparalled track record in New England. We have attorneys that have argued multiple condominium cases in the Massachusetts, Rhode Island and New Hampshire Supreme Courts, as well as the First Circuit Court of Appeals. No other condominium law firm in New England can make that claim.

Our approach to litigation is solution based. Results first, expense last. We recognize the expense and uncertainty of litigation and always seek to achieve the highest net result for our clients. We cherish a long-term attorney client partnership. We are not looking to generate enormous legal fees on a single case. However, we will fight aggressively and creatively to protect your interests.

Our litigators use their specialized knowledge of condominium and real estate law to create leverage designed both to position the case for early resolution and increase the opportunity for a successful trial outcome. Our attorneys have extensive experience prosecuting and defending condominium cases ranging from construction defect claims, developer rights and transition issues, rules enforcement, document interpretation, homeowner disputes, property damage claims, housing discrimination claims, contract disputes, premises liability claims and zoning issues.

We also represent condominium associations in insurance-related disputes. Allcock & Marcus serves as panel counsel for several insurance companies, which allows us to provide our clients with continuity of representation in complex matters as well as independence from traditional insurance counsel.

Because of our reputation as specialists in community association law, our attorneys are often consulted by other attorneys and have served and have even been qualified as testifying experts in condominium matters. Our litigators have also filed friend of court (amicus) briefs on matters of importance on condominium issues on behalf of the Community Association Institute.

Our litigators have served multiple roles on boards and in a leadership capacity for the College of Community Association Lawyers and the Community Association Institute. Our attorneys have received awards for their advocacy including being recognized as 2018 Lawyer of the Year by Massachusetts Lawyers weekly and having been selected as a New England Super Lawyer for 13 years running.

Let our experience work for you.
