Starting January 1, 2024, new regulations will mandate Condominiums and Homeowner Associations (HOAs) operating in the United States to submit Beneficial Ownership Information to FinCEN. Entities formed or registered before this date must comply by January 1, 2025. The information must be updated within 30 days of every director change. The Corporate Transparency Act (CTA) imposes strict penalties for willfully providing false information or failing to report complete and updated Beneficial Ownership Information. Violations may lead to civil penalties of up to $500 per day, along with fines of up to $10,000 and imprisonment for a maximum of two years. The objective of these regulations is to enhance transparency and combat financial crimes associated with Condominiums and HOAs. Entities affected must prioritize compliance to avoid severe consequences.
